Terms of Service

Welcome to StudntX! These Terms of Service ("Terms") govern your use of the StudntX mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. StudntX is developed and operated by an independent developer.

If you do not agree to these Terms, do not use the App.

1. Eligibility

1.1 Age Requirements

You must be at least 13 years old to use StudntX. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

1.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

2. Description of Service

StudntX is an academic productivity app that provides:

• Calendar Integration: Sync your school's academic calendar via ICS feeds
• AI Assistant: An AI-powered assistant to help with scheduling and study planning
• Reminders: Set and manage reminders for assignments and tasks
• Study Plans: Create and track study sessions

3. User Accounts

3.1 Account Creation

You may create an account using Google or Microsoft OAuth. You agree to provide accurate information during registration.

3.2 One Account Per Person

Each user may only maintain one account. Creating multiple accounts may result in termination.

3.3 Account Security

You are responsible for safeguarding your account credentials. We are not liable for any loss or damage arising from your failure to protect your account.

3.4 Account Deletion

You may delete your account at any time through Profile > Delete Account or Help Center > Delete Account. Upon deletion:

• Your profile and all associated data will be permanently deleted
• Active subscriptions will not be automatically refunded (see Section 5)

4. Acceptable Use

4.1 You Agree NOT To:

• Abuse the service or attempt to disrupt other users
• Send spam or misuse AI features
• Impersonate others or create fake accounts
• Share illegal content including copyrighted material without permission
• Attempt to hack or exploit vulnerabilities in the App
• Reverse engineer or decompile the App
• Use automated tools (bots, scrapers) to access the App
• Violate any applicable laws while using the App

4.2 Content Standards

User-generated content (profile information, study plans) must not:

• Contain hate speech, threats, or discriminatory language
• Include sexually explicit or violent content
• Promote illegal activities
• Infringe on intellectual property rights

4.3 Enforcement

We reserve the right to:

• Remove content that violates these Terms
• Suspend or terminate accounts for violations
• Report illegal activity to law enforcement

5. Subscriptions & Payments

5.1 Free and Premium Tiers

StudntX offers both free features and optional premium subscriptions ("StudntX Pro").

5.2 Payment Processing

All payments are processed through Apple's App Store. We do not directly collect or store your payment information.

5.3 Subscription Terms

• Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Price Changes: We may change subscription prices with notice; changes apply to the next billing cycle

5.4 Cancellation

• Cancel anytime through your device's App Store settings
• You retain access to premium features until the end of your current billing period
• No partial refunds for unused time

5.5 Refunds

Refund requests must be directed to Apple, as they process all payments. We cannot issue refunds directly.

5.6 Free Trials

If offered, free trials convert to paid subscriptions unless canceled before the trial ends.

6. AI Assistant

6.1 Nature of AI Assistance

The AI assistant is powered by third-party AI services and is designed to help with academic planning and productivity. It is a tool, not a replacement for professional advice.

6.2 Limitations & Disclaimers

6.3 Your Responsibility

You are solely responsible for:

• Verifying information provided by the AI
• Decisions you make based on AI suggestions
• Meeting your academic deadlines and requirements

6.4 Data Usage

Your interactions with the AI may be used to improve the service. See our Privacy Policy for details.

7. Intellectual Property

7.1 Our Ownership

StudntX, including its design, features, code, and content, is owned by the developer and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without permission.

7.2 Your Content

You retain ownership of content you create (messages, study plans, etc.). By using the App, you grant us a limited license to store, display, and transmit your content as necessary to provide the service.

7.3 Feedback

If you provide feedback or suggestions, we may use them without obligation to compensate you.

8. Third-Party Services

8.1 Integrated Services

StudntX integrates with third-party services including:

• Google OAuth and Microsoft Azure OAuth for authentication
• Third-party AI services for AI features
• Your school's calendar system via ICS feeds
• Apple App Store and Google Play Store for payments

8.2 Third-Party Terms

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

8.3 Calendar Data

When you connect your school's calendar:

• We sync data from the ICS feed URL you provide
• We are not responsible for the accuracy of data from your school's system
• You are responsible for ensuring you have permission to access the calendar

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimers

10.1 "As Is" Service

10.2 No Guarantee of Availability

We do not guarantee that the App will be:

• Available at all times
• Free from errors or bugs
• Secure from all threats

10.3 Academic Outcomes

We do not guarantee any academic results from using the App. Your grades and academic performance depend on your own effort and circumstances.

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or data breaches
• Actions of other users
• Errors in AI-generated content

11.2 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS, OR $50, WHICHEVER IS GREATER.

11.3 Jurisdictional Limitations

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit through the App

13. Dispute Resolution

13.1 Informal Resolution

Before filing any legal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing Law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles.

13.3 Arbitration Agreement

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except for claims that qualify for small claims court.

13.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. Changes to Terms

14.1 Modifications

We may modify these Terms at any time. Material changes will be communicated through:

• In-app notifications
• Email (if provided)
• Updating the "Last Updated" date

14.2 Continued Use

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you disagree with changes, you must stop using the App.

15. Termination

15.1 By You

You may stop using the App and delete your account at any time.

15.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse other users or the service

15.3 Effect of Termination

Upon termination:

• Your right to use the App ends immediately
• We may delete your data (subject to legal retention requirements)
• Provisions that should survive termination (e.g., limitation of liability) will remain in effect

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

16.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

16.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

16.5 Force Majeure

We are not liable for failures caused by circumstances beyond our reasonable control (e.g., natural disasters, internet outages, government actions).
